Your personal data are processed by Prof. Dr. Murat SONGU, whose medical office is located at Kültür Mah. Vasıf Çınar Bulvarı No:11/B Alsancak Konak-İzmir, acting as the data controller, within the scope of the Personal Data Protection Law No. 6698 (“KVKK”), the Regulation on Personal Health Data and other relevant legislative provisions, as well as the regulations of the Ministry of Health of the Republic of Türkiye and the relevant institutions and organizations, and within the framework of this Information Notice.

Prof. Dr. Murat SONGU, acting as the “Data Controller”, attaches importance to the security of personal data processed within the scope of the KVKK and other relevant legislation. In this regard, all kinds of technical and administrative measures are taken and the necessary audits are carried out. Personal data are retained for as long as the purpose of data processing remains valid. Necessary security measures are taken to prevent the stored and recorded data from being lost, falling into the hands of unauthorized persons and being used unlawfully. This Information Notice explains the scope within which your personal data collected within the framework of the services provided by our medical office are processed.

 

2. Method of Collecting Your Personal Data and Legal Grounds for Processing

Your Personal Data, depending on the healthcare services provided by Prof. Dr. Murat SONGU, are collected;

-Through your health reports, laboratory and imaging results, test results and declarations regarding your health data that you provide by visiting the medical office of Prof. Dr. Murat SONGU for examination and treatment purposes so that a medical assessment can be made regarding the treatment to be applied to you,

-Through your completion of the “Informed Patient Consent Form” regarding the treatment to be performed by Prof. Dr. Murat SONGU,

-Through the contact form that you fill out on the corporate website of Prof. Dr. Murat SONGU at [www.drmuratsongu.com](http://www.drmuratsongu.com) and [www.drmuratsongu.com/en](http://www.drmuratsongu.com/en),

-Through the electronic mails that you send to the corporate e-mail address of Prof. Dr. Murat SONGU ([[email protected]](mailto:[email protected])),

-Through photographs/video recordings taken by Prof. Dr. Murat SONGU before, after and/or during the medical procedure applied to you,

-Upon your request and where necessary; through your written/audio/visual (photograph and/or video recording) messages sent to Prof. Dr. Murat SONGU using remote connection application service providers (whatsapp/zoom.us/facetime/skype/messanger/google/instagram/facebook etc.) from which you receive services, for the purpose of enabling Prof. Dr. Murat SONGU to carry out your diagnosis and follow-ups online through remote access, and through your online audio/video calls established via these applications,

-Through your sending direct messages to the profile account of Prof. Dr. Murat SONGU on social media accounts (instagram, youtube, facebook, twitter, linkedin etc.) that you currently use and whose servers are located abroad and/or commenting on his posts,

-Through the information that you transfer by allowing it to be processed automatically through panels such as “contact us” or “get information” included in the promotions and advertisements made by Prof. Dr. Murat SONGU through social media accounts (instagram, youtube, facebook, twitter, linkedin,google etc.) that you currently use and whose servers are located abroad,

-Through photographs/video recordings recorded before, after and/or during the medical procedure performed/to be performed by Prof. Dr. Murat SONGU in order to observe your treatment,

and will be processed in accordance with the KVKK and other legislation for the purpose of enabling Prof. Dr. Murat SONGU to fully and duly fulfill his contractual and legal obligations throughout examination, preventive medicine, medical diagnosis, treatment and care services.

 

Your personal data are collected by Prof. Dr. Murat SONGU, fully or partially through automated means or through non-automated means provided that they form part of any data recording system, from electronic and/or physical environments through patient registration procedures at our medical office, printed forms and surveys, examinations carried out by Prof. Dr. Murat SONGU, medical tests/examinations, other communications that you conduct with Prof. Dr. Murat SONGU and his employees, the website of Prof. Dr. Murat SONGU, communication channels, e-mail, telephone, fax, other online and/or offline electronic communication platforms, cargo / mail, our social media accounts, healthcare institutions and laboratories with which we cooperate due to consultation or the services you receive and their integrated systems, authorized public institutions and private organizations and their integrated systems, and other methods (channels) that may be added to these in the future, for the purposes of protecting public health, preventive medicine, conducting medical diagnosis, treatment and care services, planning and managing healthcare services and their financing, by persons under the obligation of confidentiality or authorized institutions and organizations, within the scope of the personal data processing conditions (legal grounds) of processing, explicit provision in the laws, establishment or performance of a contract, legitimate interest, legal obligation, establishment, exercise or protection of a right, the fact that your personal data have been made public within the framework of your contacts through social media accounts, and, where applicable, explicit consent.

 

3. Categories of Your Processed Personal Data:

Your Personal Data and Special Categories of Personal Data specified below shall be processed by Prof. Dr. Murat SONGU in accordance with the fundamental principles stipulated in Article 4 of the KVKK, the Personal Data Processing Conditions and Purposes specified in Articles 5 and 6 of the KVKK, and limited to the purposes set out in this Information Notice; lawfully, in connection with the processing purpose, limited and proportionate, accurately and up to date, by taking all technical and administrative measures prescribed by legislation to ensure data security.

 

-Identity Information: Your name, surname, Turkish Identity Number and/or Passport Number, place and date of birth, signature and other identity data that may identify you.

-Contact Information: Your address, telephone number, e-mail address, the name-surname, Turkish Identity Number, address and telephone information of the patient’s relative to be contacted and other communication data.

-Health Information: If any, information regarding disability status, information regarding devices and prostheses used, your blood group, allergies, chronic diseases, infectious diseases, data regarding previous surgeries/operations, medications you use regularly, medical treatments, health reports, test and imaging results, prescription information, skin analysis data, habits harmful to health and other health data required for the treatment and medical procedures to be applied to you.

-Social Security Information: Information regarding private health insurance and the Social Security Institution, etc.

-Your Photographs, Voice Recordings and Video Images: Your photographs, voice recordings and/or videos taken before, during and/or after the medical procedure.

-Physical Premises Security: Records obtained through cameras located in the medical office

-Financial Information: Your bank account number, IBAN number, credit card information, billing and invoice information and other financial data, as well as financial information belonging to third parties if you share them with the Medical Office.

-Customer Transaction Information: Data such as call center records and conversations with customer representatives

-Transfer and Accommodation Information: Your transfer information, round-trip flight ticket information and hotel accommodation information within the scope of health tourism.

 

Your Personal Data are processed by Prof. Dr. Murat SONGU in accordance with the KVKK and other legislation for the purposes of creating a patient file, conducting your examination, preventive medicine, medical diagnosis, treatment and care services, carrying out your follow-ups after medical diagnosis and treatment processes, managing possible complication processes, contacting you directly, managing appointment processes, carrying out patient satisfaction and request management, fulfilling legal and contractual obligations, retaining information regarding your health data that must be kept pursuant to the relevant legislation within the prescribed periods, obtaining consultation services from other relevant specialist physicians when necessary for the proper performance of your treatment, fulfilling legal obligations in accordance with the legislation within the scope of International Health Tourism, planning the transfer and accommodation services of patients/clients coming within the framework of Health Tourism, announcing innovations regarding medical treatments and applications, medically informing third parties about the medical procedure performed, conducting promotional activities regarding medical services provided within the framework of the Health Tourism Incentive Legislation, planning and managing healthcare services and their financing, fulfilling responsibilities arising from the legal relationship established between the physician and the patient, fulfilling financial and administrative obligations, ensuring technical and commercial security and fulfilling public obligations.

 

Your Personal Data and Special Categories of Personal Data specified above shall also be processed in accordance with the purposes and legislation specified above in order to carry out your medical treatment and fulfill obligations related to your treatment. If you do not provide the relevant personal data, the legal obligations imposed on Prof. Dr. Murat SONGU, who will provide medical services as your physician, cannot be duly fulfilled and your treatment and/or recovery processes cannot be successfully carried out.

 

4. Purposes of Processing Your Personal Data:

Your personal data mentioned above may be processed within the scope explained below:

 

Fulfillment of our legal obligations under the Basic Law on Health Services No. 3359, the Decree Law No. 663 on the Organization and Duties of the Ministry of Health and Its Affiliated Institutions, the Regulation on Private Healthcare Institutions Providing Outpatient Diagnosis and Treatment, the Regulation on Personal Health Data and other relevant regulations,

Provision of healthcare services,

Protection of public health, preventive medicine, conduct of medical diagnosis, treatment and care services, planning and management of healthcare services and their financing,

Providing you with information regarding your appointment if you make an appointment,

Carrying out the planning and management processes of the internal functioning of the medical office,

Conducting analyses to improve our services,

Issuing invoices,

Verifying your identity,

Verifying your relationship with contracted institutions,

Sharing and responding to information with the Ministry of Health, private information management systems affiliated with the Ministry of Health and other public institutions and organizations, as well as responding to requests and providing information requested by other public institutions and organizations pursuant to the applicable legislation,

Responding to your questions or complaints regarding our services,

Analyzing your use of healthcare services to improve the services we provide,

Ensuring compliance with the internal policies and principles of the medical office,

Measuring and increasing patient satisfaction following your receipt of healthcare services,

Contacting you for the purpose of providing information regarding our services,

Supplying medicines or medical devices,

Providing you with information regarding new treatment methods,

Planning and execution of corporate communication activities,

Complying with other information retention, reporting and information obligations stipulated by legislation, relevant regulatory institutions and other authorities,

Maintaining communication with patients and patient relatives,

Communicating with relevant persons in emergency situations,

Providing the necessary information to regulatory and supervisory authorities and official authorities in line with their requests and audits,

Retaining information regarding your health data that must be preserved pursuant to the relevant legislation,

Without being limited to these, conducting and improving medical diagnosis, treatment and care services, planning and management of healthcare services and their financing, increasing and researching patient satisfaction and related reasons.

Personal data/personal data obtained and processed pursuant to the relevant legislation may be transferred to physical archives belonging to Prof. Dr. Murat SONGU and/or information systems belonging to Prof. Dr. Murat SONGU and stored both digitally and physically.

 

5. To Whom and for What Purposes the Processed Personal Data May Be Transferred:

Your personal data and special categories of personal data processed by Prof. Dr. Murat SONGU within the scope of the purposes explained above may be transferred, in accordance with the fundamental principles stipulated in the KVKK and within the scope of the personal data processing conditions and purposes specified in Articles 8 and 9 of the KVKK, for the realization of the processes listed above, to our business partners, physicians and healthcare institutions and organizations with whom we work, medical companies, our Certified Public Accountants and Sworn-in Certified Public Accountants who maintain and audit the Medical Office accounts, authorized public institutions and organizations, companies from which we receive support, consultancy and services in order to carry out our activities, our Medical Office lawyers and legal consultants, judicial authorities or law enforcement authorities upon request pursuant to the relevant legislation, and where deemed mandatory, to the Ministry of Health’s Examination Information Management System, and, in accordance with the provisions of the relevant legislation, particularly the KVKK, the Regulation on Patient Rights and the Regulation on Personal Health Data, to the patient’s family members/relatives, companions, proxy or legal representative and other authorized third parties for the purposes of providing information about the patient’s health status in case of medical necessity, court decision or permission of the patient/legal heirs, accompanying the patient, receiving and delivering the patient’s personal belongings/medications and carrying out payment transactions, and to domestic/foreign organizations and other third parties with whom we contractually receive and/or provide services and cooperate in order to carry out our activities.

 

The sharing of your data through service providers whose servers are located abroad is considered a “transfer of data abroad” within the scope of the Personal Data Protection Law No. 6698. Therefore, where data transfer abroad is required to be carried out by Prof. Dr. Murat SONGU, your explicit consent will be obtained. However, in the situations specified below, the data transfer will not be carried out by Prof. Dr. Murat SONGU, and your explicit consent regarding the transfer of data shall be deemed to have been given by you within the scope of the user agreement and privacy policies of the relevant service provider.

 

If you send written or voice messages, photographs or videos to Prof. Dr. Murat SONGU, conduct voice or video calls, or request remote examination/diagnosis services through communication applications (WhatsApp, Zoom, FaceTime, Skype, Messenger, Google, Instagram, Facebook, etc.) whose servers are located abroad and whose privacy policies and provisions regarding international data transfer you have accepted; you shall be deemed to have accepted the processing of your Personal Data and Special Categories of Personal Data shared through such applications by Prof. Dr. Murat SONGU in accordance with his Personal Data Protection Information Notice and Privacy Principles and communication with you through the same applications. Furthermore, it shall be deemed that you have given your explicit consent to the relevant service provider regarding the transfer of your data abroad pursuant to the privacy policies of the relevant applications previously accepted by you.

 

If you request communication through electronic mail service providers (Hotmail, Gmail, Yahoo, etc.) whose servers are located abroad and whose privacy policies and provisions regarding international data transfer you have accepted; you agree that Prof. Dr. Murat SONGU processes your Personal Data and Special Categories of Personal Data included in e-mail correspondence in accordance with his Personal Data Protection Information Notice and Privacy Principles. In addition, it shall be deemed that you have given your explicit consent to the relevant service provider regarding the transfer of your data abroad pursuant to the policies of the electronic mail service provider you use that you have previously accepted.

 

If you apply to advertisements or promotions of Prof. Dr. Murat SONGU published on social media platforms (Facebook, Instagram, Google, WhatsApp, etc.) whose servers are located abroad; the data automatically processed and transferred abroad due to your acceptance of the privacy policies and provisions regarding international data transfer of the relevant social media service provider may be transmitted to Prof. Dr. Murat SONGU by the relevant platform. Prof. Dr. Murat SONGU shall process and retain such data transferred to him within the scope of his Personal Data Protection Information Notice and Privacy Principles. In this case, you shall be deemed to have accepted the Personal Data Protection Information Notice and Privacy Principles of Prof. Dr. Murat SONGU and to have consented to the processing of your personal data and special categories of personal data within this scope and to being contacted through the contact information you have provided.

 

If you send direct messages (DMs) to the accounts of Prof. Dr. Murat SONGU on social media platforms (Instagram, YouTube, Facebook, X (Twitter), LinkedIn, etc.) whose servers are located abroad and whose privacy policies and provisions regarding international data transfer you have accepted; you agree that Prof. Dr. Murat SONGU processes your Personal Data and Special Categories of Personal Data in accordance with his Personal Data Protection Information Notice and Privacy Principles and contacts you through the relevant social media platform.

 

6. Retention Period of Personal Data

 

Your personal data are retained, where your explicit consent exists, based on such consent, and where explicit consent does not exist, where retention is explicitly stipulated by legislation, where it is directly related to the establishment and performance of contracts, where it is necessary for the establishment, exercise or protection of a right, where retention is mandatory for the legitimate interests of Prof. Dr. Murat SONGU and his medical office provided that it does not harm your fundamental rights and freedoms, or where it is necessary for the fulfillment of any legal obligation.

 

Your personal data are retained throughout the continuation of your treatment and, if your treatment ends, for a period of 10 years from the date of termination.

 

7. Your Rights Listed in Article 11 of the Personal Data Protection Law:

 

Pursuant to Article 11 of the Law, as the personal data owner, by applying to Prof. Dr. Murat SONGU in writing or through other methods determined by the Personal Data Protection Board, you have the right to learn whether your personal data are processed, request information if your personal data have been processed, learn the purpose of processing your personal data and whether they are used in accordance with that purpose, know the third parties to whom your personal data are transferred domestically or abroad, request the correction of your personal data if they have been processed incompletely or inaccurately and request notification of such correction to third parties to whom the personal data have been transferred, request the deletion or destruction of your personal data if the reasons requiring processing cease to exist despite having been processed in accordance with the Law and other relevant legislation and request notification of such action to third parties to whom the personal data have been transferred, object to the occurrence of a result against you through the analysis of processed data exclusively by automated systems, and request compensation for damages if you suffer damage due to the unlawful processing of your personal data.

 

In order to exercise your rights specified above, you may personally deliver your request containing the necessary information identifying your identity and your explanations regarding the right you wish to exercise among the rights specified in Article 11 of the Law to Prof. Dr. Murat SONGU or send it through a notary public. Your requests included in your application shall be concluded by Prof. Dr. Murat SONGU free of charge as soon as possible and no later than thirty days, depending on the nature of the request.

 

Pursuant to Article 10 of the Personal Data Protection Law No. 6698 titled “Obligation of the Data Controller to Inform”, I have read and understood this Information Notice prepared regarding who will process my personal data, for what purpose they will be processed, to whom and for what purpose the processed personal data may be transferred, the method and legal basis for collecting personal data and my rights set forth in Article 11 of the Law, and I have been informed in detail by Prof. Dr. Murat SONGU, acting as the data controller, on this matter, I understand and consent.
